Welcome to Sylienne. These Terms of Service govern your access to and use of the Sylienne website, products, reservations, purchases, and related services. By using this website, placing a reservation, or completing a purchase, you agree to these Terms.

1. About Sylienne

Sylienne is an independent footwear and accessories studio working between New York and Italy. References to “Sylienne,” “we,” “us,” “our,” and “the studio” refer to the legal entity operating the Sylienne brand, website, products, reservations, orders, and customer services.

2. Website Use

You may use this website for personal, lawful, non-commercial purposes only. You agree not to misuse the website, interfere with its operation, attempt to access restricted systems, use automated tools to scrape or collect data, abuse the reservation or checkout process, impersonate another person, or engage in fraudulent activity.

We may suspend, restrict, cancel, or refuse access to any account, reservation, order, or website activity that we believe violates these Terms or harms Sylienne, our customers, or our services.

3. Products

Sylienne products may include footwear, handbags, accessories, and related items. Product availability, colors, sizes, finishes, materials, pricing, and delivery windows may vary by collection, production batch, and region.

We make every effort to present our products accurately. However, slight variations in color, tone, texture, finish, shape, or appearance may occur due to screen settings, material characteristics, production methods, and hand-finishing.

We reserve the right to modify, discontinue, limit, or update any product, colorway, size, material, finish, collection, or product description at any time.

4. Reservations and Orders

A reservation secures your selected product, size, color, or style for an upcoming production or launch release, subject to availability and successful payment authorization.

Depending on the product and checkout terms shown at the time of reservation, you may be charged a deposit or the full purchase price. If a remaining balance is due, we will notify you before the item is prepared for shipment.

A reservation or order is not final until accepted and confirmed by Sylienne. We may decline, cancel, or refund a reservation or order if a product becomes unavailable, if payment authorization fails, if we suspect fraud or misuse, if incorrect information is provided, or if fulfillment becomes impracticable for reasons beyond our reasonable control.

5. Pricing and Payment

The product price shown at the time of reservation or purchase is the product price you pay, excluding applicable taxes, duties, customs fees, shipping upgrades, or other charges disclosed at checkout or required by law.

If production costs increase before launch, confirmed reservations will not be charged the increase. We may update pricing for future reservations, future orders, later production batches, or new releases at any time.

All payments must be made through the payment methods offered at checkout. By providing payment information, you confirm that you are authorized to use the selected payment method.

6. Taxes, Duties, and Customs

Applicable sales tax, VAT, duties, customs fees, import charges, brokerage fees, or similar government charges may be added at checkout or charged by the carrier or local authority upon delivery, depending on the destination.

Unless expressly stated at checkout, the customer is responsible for any duties, customs fees, taxes, or import charges required by the destination country.

7. Shipping and Delivery

Shipping options and estimated delivery windows are provided at checkout or on the applicable product, Shipping, or FAQ page. Delivery dates are estimates only and are not guaranteed.

Sylienne is not responsible for delays caused by production timing, carriers, customs, weather, incorrect shipping information, security checks, payment issues, or events outside our reasonable control.

Risk of loss passes to you when the carrier marks the package as delivered to the shipping address provided at checkout.

8. Cancellations, Returns, and Exchanges

Reservations may be cancelled for a full refund until the item has shipped, unless the product page or checkout terms state otherwise.

Once an item has shipped, our return and exchange policy applies. Eligible items may be returned within 30 days of delivery, subject to the conditions listed on our Returns page.

Returned items must be unworn, unused, undamaged, and returned in their original packaging, including boxes, dust bags, protective materials, tags, and any included accessories.

Sylienne offers one complimentary size exchange per eligible pair of shoes, subject to availability. Additional exchanges, international exchanges, or returns may be subject to shipping costs, duties, customs fees, or other charges where applicable.

Final sale items, personalized items, altered items, worn items, damaged items, or items returned without original packaging may not be accepted for return or exchange.

9. Materials, Care, and Craftsmanship

Sylienne products are made with carefully selected materials and considered production methods. Some products may include plant-based, vegan, or alternative leather materials, as described on the applicable product page.

Natural variations or slight changes in texture, tone, finish, or structure may occur and are not considered defects. These characteristics are part of the material and production character of the product.

Sylienne products should be used and cared for according to the care instructions provided. Footwear and accessories may be affected by moisture, friction, pressure, heat, storage conditions, repeated wear, and contact with rough or delicate surfaces.

We are not responsible for damage caused by improper use, improper storage, exposure to water or harsh conditions, third-party cleaning, unauthorized repairs, misuse, accidents, or failure to follow care guidance.

10. Craftsmanship Warranty

Each eligible Sylienne product carries a one-year craftsmanship warranty against manufacturing defects under normal use.

This warranty does not cover ordinary wear and tear, sole wear, heel tip wear, scratches, stains, creasing, water damage, accidental damage, improper care, misuse, unauthorized repairs, fit preference, or damage caused by use inconsistent with the product's intended purpose.

If you believe your item has a manufacturing defect, contact [email protected] with your order information and photographs of the issue. We may request that the item be returned for inspection before determining whether a repair, replacement, credit, or refund is appropriate.

11. Intellectual Property

All content, designs, and materials on this website and related brand channels belong to Sylienne or its licensors. This includes, without limitation, the Sylienne name, logos, product names, product designs, sole designs, heel designs, photography, videos, copy, graphics, layout, packaging, code, and all other creative materials.

You may not copy, reproduce, scrape, mirror, distribute, modify, imitate, sell, commercially exploit, or use any Sylienne content, design, image, product detail, or material without our prior written permission.

You may not use Sylienne content to train, develop, or improve artificial intelligence models or machine learning systems without our prior written permission.

Nothing on this website grants you any right, title, or license in or to Sylienne's intellectual property.

12. Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, shipping carriers, analytics providers, email platforms, social media platforms, and other service providers.

15. Limitation of Liability

To the fullest extent permitted by law, Sylienne's total liability for any claim arising from your use of the website, reservation, purchase, product, or service is limited to the amount you paid for the applicable product or reservation.

Sylienne will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of goodwill, delay, inconvenience, or emotional distress, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits any liability that cannot be limited under applicable law.
